How California courts treat expert testimony
The rules every expert must meet in California, medical or not.
Kelly / Sargon
New scientific techniques must meet the Kelly test of general acceptance (People v. Kelly, 17 Cal.3d 24 (1976)). All expert opinion is also subject to trial-court gatekeeping under Evid. Code §§ 801(b) and 802 (Sargon Enterprises v. USC, 55 Cal.4th 747 (2012)). Under People v. Sanchez, 63 Cal.4th 665 (2016), experts may not relay case-specific hearsay as true.
Trial courts are the superior courts, one in each of the 58 counties. Appeals go to the California Courts of Appeal (six appellate districts), and the highest court is the Supreme Court of California.
- U.S. District Court, Northern District of California
- U.S. District Court, Eastern District of California
- U.S. District Court, Central District of California
- U.S. District Court, Southern District of California
California medical expert requirements
What a medical expert must satisfy before testifying in a California malpractice case.
Who qualifies as a medical expert
California has no same-specialty or percentage-of-time statute. Qualification turns on Evid. Code § 720 and familiarity with the standard of care under similar circumstances. Experts testifying against emergency department physicians need substantial ED experience within the last 5 years (Health & Safety Code § 1799.110(c)).
Certificate, affidavit or presuit requirement
No certificate of merit or expert affidavit is required for medical malpractice. The plaintiff must give 90 days’ written notice of intent to sue (CCP § 364); notice served within the last 90 days of the limitations period extends the deadline by 90 days.
Out-of-state experts
No California license, registration or fee is needed to testify. Workers’ compensation is different: a Qualified Medical Evaluator (QME) must hold a California license and be certified by the DWC Medical Unit (Lab. Code § 139.2).
Statute of limitations
Three years from injury or 1 year from discovery, whichever comes first. The 3-year outer limit is tolled only for fraud, intentional concealment, or a non-therapeutic foreign body (CCP § 340.5).
Damage caps
MICRA caps noneconomic damages only, as changed by AB 35 (2023). For cases filed in 2026 the cap is $470,000 for injury and $650,000 for wrongful death, rising each January until it reaches $750,000 / $1,000,000 (Civ. Code § 3333.2). Economic damages are uncapped.
Case & Record Review
Thorough review of records, imaging, reports and evidence.
Written Opinions
Clear, defensible expert reports and affidavits.
Deposition Testimony
Prepared, credible testimony under examination.
Trial Testimony
Plain-language explanation for judge and jury.
Defense and prosecution experts in California
Courts fund defense experts for indigent defendants when reasonably necessary to the defense (Corenevsky v. Superior Court, 36 Cal.3d 307 (1984); Penal Code § 987.2). Capital defendants may apply confidentially for investigator and expert funds under Penal Code § 987.9. Courts may also appoint their own experts under Evid. Code § 730.
We place experts in homicide, abusive head trauma (shaken baby), child abuse and non-accidental trauma, competency and criminal responsibility, and vehicular cases.

Questions attorneys ask about California experts
Does California use Daubert or Frye?
Neither exactly. New scientific techniques must meet the Kelly (Frye-based) general-acceptance test, and since Sargon (2012) trial judges also screen every expert opinion for reliable foundation and reasoning under Evid. Code §§ 801 and 802.
What are California’s MICRA caps in 2026?
For cases filed in 2026, noneconomic damages are capped at $470,000 for injury and $650,000 for wrongful death under Civ. Code § 3333.2, as amended by AB 35. Economic damages are uncapped.
Is a certificate of merit required for California medical malpractice?
No. California requires 90 days’ pre-suit notice under CCP § 364, which needs no expert signature.
